By accessing or using Transcription App ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.

2. Account Registration and Security

To use our Service, you must:

  • Be at least 13 years old (COPPA compliance)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Subscription and Payment Terms

Subscription Plans

Billing

  • Subscriptions are billed monthly in advance
  • Payments are processed through our secure payment provider
  • You authorize us to charge your payment method on file
  • Failed payments may result in service suspension

Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused minutes
  • Unused minutes do not roll over to the next billing period

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Upload content that is illegal, harmful, or violates others' rights
  • Transcribe content without proper authorization or consent
  • Attempt to circumvent usage limits or security measures
  • Share account credentials with unauthorized users
  • Use automated systems to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract source code
  • Use the Service for any unlawful purpose

5. Intellectual Property Rights

Our Property

The Service, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our property without written permission.

Your Content

You retain ownership of audio files and transcripts you create. By using the Service, you grant us a limited license to process your content solely to provide the Service.

Feedback

Any feedback or suggestions you provide may be used by us without obligation to you.

6. Service Availability and Limitations

  • We strive for high availability but do not guarantee uninterrupted service
  • We may perform maintenance that temporarily affects availability
  • Transcription accuracy depends on audio quality and may vary
  • We reserve the right to modify or discontinue features
  • Usage limits apply based on your subscription plan

7. User Content and Ownership

You are solely responsible for the content you upload. You represent and warrant that:

  • You own or have rights to use the content
  • The content does not infringe on others' rights
  • You have obtained necessary consents for recorded conversations
  • The content complies with all applicable laws

8. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees
  • Abuse the Service or other users

You may delete your account at any time through your account settings.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or uninterrupted, or that transcriptions will be completely accurate.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

For small claims, you may bring an action in small claims court in your jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
